Liability Disclaimer
The photographer cannot be held liable, to the extent permitted under United Kingdom law, for any losses incurred by the client as a direct or indirect result of any photographic work undertaken. This includes, but is not limited to, claims made by third parties. Any liability arising from unforeseen circumstances will also remain limited in accordance with applicable legal provisions.
Information that is required to be provided prior to or on the day of delivering any photography service
A) It is essential to be given a detailed plan or schedule for the day, outlining the specific times and deadlines for all photography activities and requirements in writing and email.
B) To be given adequate time to rest or to take a much-needed break when necessary.
C) To talk to me in a calm, clear, and easy-to-understand manner while providing enough detailed information to ensure I know exactly what needs to be done, and to also give me adequate time to process, respond back thoughtfully, or to fully understand everything being communicated to me.
D) If something's cannot be achieved because of multiple reasons I will honestly and openly tell you that this is something that can indeed happen, and it is a possibility that cannot be ignored.
E) Discuss upcoming changes thoroughly and well in advance taking the time to explain the details clearly and addressing any questions, concerns, or reservations they may have about the situation.
F) Consider options like adjusted hours or the flexibility to take short, rejuvenating breaks whenever necessary.
G) On lots of occasions, my PA will need to travel and attend with me, so please understand this situation and be aware of it as part of my specific requirements that must be met before initiating any kind of contact.
How I Handle Your Photos
We take photo storage and usage seriously to ensure your privacy and convenience. Photos are stored securely for up to six months before being automatically deleted so please make sure you keep copies When you download for Future use.
Only a carefully selected few are saved and used on our website or social media platforms, ensuring that all content shared is thoughtfully curated and relevant. Rest assured, your memories are handled with care and respect throughout this process.
Terms of Photograph Usage
If photographs have been sold to you for personal use only, they must not be used for other purposes such as magazines, books, other websites, or any commercial platforms without prior agreement. If it is found that photographs have been used in such ways without consent, a fee of £50 per photograph will be charged. The responsibility to pay this fee lies entirely with the client.
Image Copyright Information
Jackprophotographypictures retains full copyright to all images at all times, across all platforms and locations globally. As the photographer (me), I exclusively maintain the rights to use, distribute, and manage the photographs under all circumstances. Additionally, photographs may be made available for news, editorial purposes, or related uses solely at my discretion and judgment.
A) JackProPhotographyPictures retains the exclusive right to decline the provision of images or the issuance of a reproduction license to any third party, upon the Client's request. This decision shall be made at its sole discretion, without any obligation to furnish a justification for such refusal.
B) Unless expressly agreed upon in writing and duly confirmed by all parties involved, any subsequent licenses pertaining to the images shall remain strictly governed by these Terms and Conditions, as stipulated and adhered to by all relevant parties.
Reimbursement for Additional Costs
The Client agrees to reimburse the Photographer for any additional expenses incurred, including but not limited to parking fees and travel costs, which are directly necessary for the completion of the agreed-upon photography services. These reimbursements ensure the Photographer can deliver the best possible results without undue financial burden while fulfilling the Client’s requirements.
Client Cooperation Agreement
The Client agrees to assist and cooperate fully with the Photographer to ensure the creation of the desired photographs. This includes, but is not limited to, clearly identifying specific individuals, groups, or scenes to be photographed. The Client shall also take time to pose as directed by the Photographer to achieve the best results. Additionally, any required preparations, such as providing access to locations or ensuring timely participation, are the Client’s responsibility to facilitate a smooth and efficient photography process.
Important Information About Deposits and Cancellations
All deposits are non-refundable if the Client cancels or modifies the agreed-upon engagement for any reason. However, in the unlikely and unexpected event that the Photographer is unable to appear at the scheduled location and time without giving the Client a minimum of 24 hours' prior notice, the full deposit will be promptly refunded to the Client as a gesture of goodwill and professionalism.
Delivery of Proof Photographs
Proof photographs will be delivered to the Client through platforms such as WeTransfer, Send Anywhere, or any other specified system as agreed upon. This ensures a secure and efficient transfer of files while allowing flexibility based on the Client's preferences.
Clients will receive a link to download their images, which must be accessed and downloaded within one week of receipt. After downloading, it is the client’s responsibility to securely store the images for future use.
I recommend downloading and backing up your images promptly to avoid any loss.
Guidelines for Providing Assignment Details
When submitting assignment details, it is essential to include comprehensive and organised information to ensure clarity and efficiency in the process. Below are the key elements that must be included:
The who, what, where, when, and why: Clearly outline the key details of the story or project, including the individuals involved, the subject matter, the location, the timeline, and the purpose or significance.
Share an outline or a draft of the story: Provide a concise outline or an initial draft to offer a clear direction and structure for the assignment.
Contact information of the source: Ensure you include accurate contact details for the primary source of the story to facilitate follow-ups or verification.
Contact information for the reporter writing the story: Provide the reporter's contact details to ensure seamless communication and collaboration throughout the process.
Newsroom contact for questions or issues: Include a designated newsroom contact for resolving queries or addressing any concerns related to the assignment.
By following these guidelines, you can ensure a smooth workflow and enhance the quality and reliability of the final output.
Important Notice on Rejection Policy
Unless a rejection fee has been agreed in advance, there is no right to reject on the basis of style or composition. This policy ensures clarity and fairness in all projects, establishing that subjective preferences regarding creative work, such as design or written content, must be addressed upfront. Clients are encouraged to communicate expectations clearly before work begins, and any specific requirements or terms, including potential rejection fees, should be discussed and formalised in writing. By adhering to this approach, both parties can collaborate effectively and minimise misunderstandings.
Important Notice: Responsibility for Image Downloads
It is the client's responsibility to ensure all images are downloaded and saved within the specified time period. Failure to save or download these images on time, or any subsequent loss of images for these reasons, rests solely with the client. Please note that if images are lost due to not being downloaded or saved as required, an additional fee may apply for recovery or replacement services. We strongly recommend promptly downloading and securely storing your images to avoid any inconvenience or extra costs.
Covid-19 Policy: Commission Cancellations or Postponements
In the event of a regional or national lockdown, or if the photographer is required to self-isolate due to coronavirus, the photographer cannot be held responsible for the cancellation or postponement of a commission. These circumstances are beyond the photographer's control, and every effort will be made to communicate updates promptly and reschedule the commission where possible. Your understanding and flexibility during such unprecedented situations are greatly appreciated.
A) I kindly ask people to refrain from touching the camera, as well as any of the other equipment.
B) Avoid coming into contact with surfaces or handling any items, unless it is absolutely essential or completely unavoidable.
C) Always use PPE when required to do so, ensuring that the necessary equipment is provided by the client as part of their responsibility.
D) Stop work and self-isolate immediately if any symptoms appear or you notice any unusual changes in your health.
E) To be promptly informed and contacted immediately if any members of staff have come down with any symptoms of COVID-19, ensuring notification occurs straight away as soon as possible.
F) Ensure that everyone involved in the shoot is fully informed and aware of all the above details and considerations to guarantee a smooth and successful process.
These terms and conditions shall apply to the contract to the exclusion of any other terms and conditions put forward by the client. Please refer to your contract or invoice for further details regarding the specific agreements and scope of your service. The contract will remain binding and enforceable under the terms outlined within the provided documentation.

The contract will be only communicated with the person who made the booking and paymeny or first of contact.
Deposit : A non- refundable 50% deposit secures the booking and will be deducted from the final fee the rest of payment will needs paid in 24 hours images of photographs has been delivered.
(After 24 hours there will be daily £12 pounds charge fee add to the final price )
Quotes provided are valid for 30days, after this time a new Booking request will need to be submitted.

Agreement to Terms of Service
By signing this document, you confirm that you have read and agreed to the terms of service outlined on our website. This agreement grants permission for the use of all user images and photographs for purposes including marketing, public relations, editorial features, and advertising. Please note, even for voluntary service, this contract must be reviewed and agreed upon to proceed.
Image Licensing Terms
All images are licensed exclusively to the named client for use as specified in the agreement. These images are intended for the client’s use only and may not be sold, distributed, or sub-licensed in any form without prior written permission from me. Any such permissions must be explicitly agreed upon and included in this contract before use, not after. By adhering to these terms, clients ensure proper usage and compliance with licensing agreements.
Client Responsibilities for Photography taking place
It is the client’s responsibility to ensure that all necessary clearances have been obtained to allow photographs to be taken without any hindrance or infringement of trademarks, copyrights, or other legal restrictions. This includes securing permissions for the use of specific locations, ensuring no intellectual property rights are violated, and, where applicable, obtaining written parental permission for minors involved in the photographs. By addressing these requirements in advance, the client helps ensure a smooth and compliant photography session.
Cancellation Fees Policy
We understand that plans can change, but when a commissioned job or scheduled date is cancelled, a cancellation fee will apply. This is due to the fact that the agreed date has already been set aside, and other work opportunities have been turned away to accommodate your commission. For cancellations or postponements made between 22 and 30 days prior to the scheduled date, a cancellation fee will be charged. We appreciate your understanding and cooperation in this matter.
Between 22 and 30 days before shoot – up to 25% of quoted fees
Between 14 and 21 days before shoot – up to 50% of quoted fees
Between 13 and 7 days before shoot – up to 75% of quoted fees
Less than 7 days before shoot – up to 100% of quoted fees
A) In the event that any invoice issued to the Client remains unpaid beyond the specified Due Date, all outstanding invoices issued to the Client shall immediately become due and payable, irrespective of whether the original issue date of such invoices falls within the standard 30-day payment period. Under such circumstances, Dave Phillips Photography reserves the right to classify these invoices as overdue and to initiate appropriate legal proceedings for the recovery of the amounts owed. This policy ensures that all financial obligations are addressed promptly and in accordance with established terms.
B) JackProPhotographyPictures reserves the right to suspend all ongoing services, including but not limited to the provision of Downloadable Web Pages or other methods of image distribution, should any invoice issued to a Client remain unpaid past its due date. This suspension may be implemented irrespective of the specific circumstances leading to the delay. Additionally, JackProPhotographyPictures maintains the discretion to notify relevant third parties, whose interests may be directly or indirectly impacted, of the suspension and its underlying cause, thereby upholding a commitment to transparency and effective communication.
Image Usage Rights
The photographer (me) reserves the right to use any images taken during your session on my website or in promotional materials, including social media platforms such as Facebook, Instagram, and X. If you wish to make alternative arrangements regarding the use of your photographs, this must be agreed upon prior to the commencement of any work. Unless otherwise specified, I retain the right to use the photographs in any manner, at any time.
Image Quality and Copyright Information
Please note that the photos currently uploaded are not the highest quality versions available. Once payment is agreed, you will receive the full-quality images via WeTransfer or another preferred file transfer system. However, I will retain full copyright ownership of all images as per the Copyright, Designs and Patents Act 1988. This ensures that while you have access to high-quality versions for your use, the rights to the images remain with me as the creator.
Statement on the Use of Work for AI Training
AI: I do not consent to my work being used to train AI models. The client does not have the right to consent to my work being used for this purpose. All rights to my work remain with me as the original creator, and any unauthorised use of my content to train AI or for similar purposes is a violation of my intellectual property rights. Please respect this position and ensure my work is used only for its intended and agreed-upon purposes.
Zero Tolerance Policy
I have a strict zero-tolerance policy towards abuse, threatening behaviour, and misconduct. This includes any form of verbally or physically abusive behaviour. Such actions will not be tolerated under any circumstances. Our priority is to maintain a safe, respectful, and welcoming environment for everyone. We reserve the right to take immediate action, including removal from the premises or termination of services, if this policy is breached. Let’s work together to ensure a positive experience for all.
Image Delivery Policy
We take pride in delivering professionally edited images tailored to meet your expectations. Please note that raw image files will not be provided. Only the final, edited photographs will be delivered. Additionally, unless a rejection fee has been agreed upon in advance, there is no entitlement to reject images based on their style or composition. By proceeding, you acknowledge and accept these terms, ensuring a smooth and transparent experience.

Delays can occasionally occur in photography services due to circumstances beyond the photographer’s control. These include, but are not limited to, adverse weather conditions, industrial action, or acts of terrorism. While every effort is made to adhere to agreed schedules, it’s important to understand that such unforeseen events may impact timelines. In these cases, the photographer cannot be held liable for resulting delays, as they are outside their reasonable control. Clear communication and contingency planning are always prioritised to minimise disruption as much as possible.
